Comelec disqualifies Candijay Mayor

FOR VIOLATING the procedural requirements in the filing of his Certificate of Candidacy (COC), the Commission on Elections (COMELEC) disqualified on Thursday re-electionist Mayor Sergio G. Amora Jr. from running as mayor of Candijay, Bohol in the May 2010 polls.
The Comelec 2nd division admonished Amora that “procedural rules are not to be belittled or dismissed simply because their observance may have resulted in prejudice to a party’s substantial rights….”
In his petition docketed as SPA No. 10-046(DC), petitioner Arnielo S. Olandria said that when Mayor Sergio Amora Jr. filed his COC on December 1, 2009, he “merely presented to the notary public, Atty. Oriculo Granada, his Community Tax Certificate instead of a competent proof of his identity.”

The petitioner said this is contrary to the requirements of the Omnibus Election Code and the 2004 Rules on Notarial Practice.
Because Amora’s COC was not properly sworn to, Olandria said, his COC was of no force and effect.
Amora did not dispute the observation of Olandria but said that since the petition was in the nature of a petition to deny due course or to cancel the COC, it was already filed out of time because it should have been filed within 25 days from the filing of the questioned COC.
The Candijay Mayor also said that the Olandria petition should be dismissed because the alleged defect did not amount to a material misrepresentation.
He added that he is personally known to the notary public, being a close acquaintance and therefore, he should no longer be required to present any form of identification.
But the Comelec 2nd division thru Presiding Commissioner Nicodemo T. Ferrer and Commissioners Lucenito Tagle and Elias Yusoph did not agree with Amora.
Citing Section 73 of the Election Code which requires the filing of a “sworn certificate of candidacy,” the Comelec resolved that Mayor Amora must be considered as having filed a mere scrap of paper.
“The inescapable conclusion should, therefore, be that Respondent’s COC was rendered invalid when the Respondent only presented his Community Tax Certificate to the notary public. Respondent’s defense, that anyway, he is personally known to the notary public is unavailing. It must be noted that Respondent did not even bother to present evidence to prove this allegation. At any rate, had Respondent presented proof on this specific allegation, the same would not have been of any moment, considering that a statement to the effect that an affiant is personally known to the notary public should have been explicitly stated in the jurat portion of the COC.
The Comelec also invoked the ruling of the Supreme Court in De Guzman vs. Provincial Board of Canvassers of La Union that “where the COC lacks the required formality of an oath, it may be assailed before proclamation and the candidate who filed the defective COC may be disqualified and eliminated from the list of candidates.”
The Comelec likewise reminded Amora that compliance with procedural requirements is mandatory as they “have their own valid reason d’etre in the orderly administration of justice and thus, to summarily brush them aside may result in arbitrariness and injustice.”
The poll body also brushed aside as misplaced the argument of Amora that the petition filed by Olandria was in the nature of a petition to deny due course or to cancel a COC.
The Olandria petition, the Comelec said, was filed in accordance with Comelec Resolution 8696 which provides for the rules in cases of petitions to disqualify a candidate for lack of qualifications or possession of some grounds for disqualification.
Contrary to Amora’s contention, the Olandria petition may be filed on grounds other than material misrepresentation in the COC and “on any day after the last day for filing of certificates of candidacy but not later than the date of proclamation,” the Comelec said.
When interviewed by the TIMES last Friday, Olandria expressed elation and said the Candijaynons have good reason to be happy.
“The call for reforms is at hand. For a long time now, the people of Candijay have been longing for change. And many times, they failed because the present administration does not want change. With the favorable ruling of the Comelec on my petition, I hope the people of Candijay will now be properly guided on their choice of leaders when they cast their votes on May 10,” Olandria said.
The Candijaynons should not waste their votes on Mayor Amora anymore, he added, because even if Amora wins, which is unlikely, he could not sit because of the disqualification from Comelec.
Olandria reiterated his appeal to support the candidacy of Trygve Olaivar who is running for mayor under the Nationalist People’s Coalition (NPC).
Meanwhile, when interviewed over Cuentas Claras last Friday, Olayvar vowed to be fully transparent.
“I plan to place a big board in front of the municipal hall. The board would contain the expenditures incurred by the municipal government. Everything will be listed there so that the people will know where their money is spent,” Olayvar said.
He also plans to establish a hospital that is equipped with basic medical equipment like an X-Ray machine.
He added that many municipal roads in Candijay are in dire need of repairs.
“I know what the Candijaynons need because I understand their needs,” Olayvar concluded.

Mr.Olaivar, You are not the congress, the senate nor the PRESIDENT. Stop all your illogical thoughts and kaloka na ambition. Just stick it to LOCAL agendum. after all, you are only running for Mayor. Should you win, you can’t make a bill cause you are simply a mayor whose in charge of the town.
Please leave candijay alone. we are not acquainted with this kagubot, goons, false propaganda that you bring to candijay. CAndijay is a peaceful town with high literacy rate (meaning, dili dali mailad ang mga tawo).
i believe it is not FINAL AND EXECUTORY. Even mayor amora wasn’t given the chance to respond to Mr. Olandria’s complaint. I’m sure, mugna na pud ni sa COMELEC fixer. even ang comelec officer sa candijay, wala nadawat nga resolution from comelec about ani. documents like these should be made public.
